
Discharge Upgrades & VA Benefit Eligibility
An Other-Than-Honorable, bad-conduct, uncharacterized, or incorrect discharge can block doors, but it does not answer every benefits question and it may be challengeable. You need to know which decision to attack: the military record, the VA eligibility decision, or both.
For women whose service changed after MST, PTSD, TBI, harassment, intimate-partner violence, or retaliation, the connection between trauma and conduct is not an excuse. It is legally relevant evidence that review boards are directed to consider.
Two Different Decisions Can Block You
A discharge upgrade and a VA character-of-discharge decision are related, but they are not the same case. Choosing the wrong door wastes time.
1. The military record
The service department controls the DD-214. Its review boards can change the characterization, narrative reason, separation code, reenlistment code, or other military-record entries when the discharge was improper, inequitable, or unjust.
Result: the military record itself can change.
2. VA benefit eligibility
The VA can make a character-of-discharge determination for its own benefits rules. It examines the period of service, reason for separation, statutory and regulatory bars, compelling circumstances, and limited health-care exceptions.
Result: VA may treat service as qualifying without rewriting the DD-214.

A general court-martial and certain statutory bars require special analysis. A dishonorable discharge imposed by general court-martial is not handled like an ordinary administrative OTH. Get an individualized record review before choosing a path.
MST, PTSD, TBI & Liberal Consideration
Defense Department guidance directs review boards to give liberal consideration when a mental-health condition, PTSD, TBI, MST, or related trauma may have contributed to the conduct or discharge. The board should not demand that a condition was perfectly diagnosed while you were still serving.
Existence
Show that the trauma or condition existed during service through medical evidence, markers, lay statements, or a credible timeline.
Connection
Explain how symptoms such as avoidance, hypervigilance, substance use, absence, conflict, or self-protection contributed to the specific misconduct.
Weight
Ask the board to weigh the condition and trauma evidence liberally, especially where the service record changed sharply after the event.
Equity
Show the full service record, disproportional punishment, command failures, rehabilitation, and the consequences of leaving the discharge unchanged.
Evidence That Builds the Record
The strongest applications show the whole person before, during, and after the conduct. Do not submit only a form and hope the board reconstructs the story.
Your DD-214, separation packet, personnel file, and complete service treatment records
A personal statement that explains the timeline, the conduct, and what was happening underneath it
MST markers such as transfers, performance decline, medical visits, retaliation, leave, or sudden discipline
A current PTSD, depression, anxiety, TBI, or other diagnosis and a clinician’s explanation of the connection
Buddy, roommate, partner, family, chaplain, supervisor, or coworker statements
Awards, strong evaluations, deployment history, and service before the decline
Post-service treatment, education, employment, recovery, caregiving, and community records
Evidence of discrimination, harassment, retaliation, command failure, or procedural error
The Filing Sequence
Get the complete record
Start with the DD-214, discharge packet, personnel file, medical record, court-martial or nonjudicial-punishment documents, and every evaluation before and after the conduct.
Choose the decision you need changed
If VA benefits are blocked, ask whether a VA character-of-discharge decision is needed. If the DD-214 itself is wrong or unjust, choose the military Discharge Review Board or Board for Correction of Military/Naval Records.
Build the theory, not just the form
State whether the discharge was improper, inequitable, or unjust. For MST, PTSD, TBI, or related mental health, connect the condition to the specific conduct and ask for liberal consideration.
Submit the right application
Use DD Form 293 for a Discharge Review Board and DD Form 149 for a correction board. Keep a complete copy, proof of submission, and every attachment in the order cited by your statement.
Protect the VA claim separately
A military upgrade can take time. Do not assume you must wait to ask VA for a character-of-discharge determination or to preserve a disability-claim effective date. These are separate processes.

Discharge Upgrade Questions
Does an OTH discharge automatically bar all VA benefits?
No. An other-than-honorable discharge can trigger a VA character-of-discharge review, but the VA makes its own decision under federal benefit rules. The exact reason for separation, any statutory or regulatory bar, and compelling circumstances all matter.
What is the difference between a discharge upgrade and a VA character-of-discharge decision?

Can I apply after 15 years?
Yes. The 15-year limit generally applies to Discharge Review Boards. A correction board using DD Form 149 may still consider the case; its normal filing rule can be waived in the interest of justice.
Can I request a hearing?
Discharge Review Boards can conduct record reviews and personal-appearance hearings. A hearing can help in some cases, but a complete written record remains essential because the evidence and legal theory must stand on their own.
What if the board denied me before?
A prior denial does not always end the matter. New medical evidence, newly available service records, a stronger liberal-consideration argument, a different board with authority over the requested correction, or a challenge to the prior process may create another path.
Your discharge record and your VA eligibility deserve separate review
If the VA has already denied or blocked benefits, an accredited representative can review the VA decision and tell you which benefit path is still open. Military discharge-upgrade representation may require separate qualified counsel.
